What a Construction Agreement Should Cover: A Homeowner's Guide
Most disputes between homeowners and builders begin the same way: something important was never written down. The rate was agreed on a phone call, the specification lived in a WhatsApp message, and the payment schedule was “we will see as we go”. When you are shortlisting the best builders in Mysuru, the quality of the construction agreement a builder offers you is one of the clearest signals of how the project itself will run. A builder who hands you a vague two-page contract is telling you, politely, how the next twelve months will feel.
A good agreement is the document you will return to every time a question comes up: what brand of wiring was promised, when the next payment is due, who pays the sanction fee, what happens if a wall cracks six months after handover. This guide walks through what it should contain, clause by clause, so you can read any builder’s draft with a critical eye.
At Uniq Builders we have been constructing homes since 2009, with more than 200 projects across Mysuru, Bengaluru, Mandya, Srirangapattana, Chamarajanagar and Kollegala, and every one of them has been built to a written specification. We use our own practice as the worked example below, but the checklist applies to any builder you are evaluating.
Scope and specification: the heart of the agreement
The single most important attachment to any construction agreement is the written specification, the document that converts a rate per square foot into an actual house. Without it, “standard fittings” can mean almost anything.
A proper specification should name, in writing:
- Structural details: concrete grade, steel specification, and confirmation that the structural design is based on a soil test of your plot, not a generic assumption
- Masonry, plastering and waterproofing methods
- Flooring material and the rate or range allowed for tiles or granite
- Doors and windows: frame material, shutter type, hardware
- Electrical: wire brand, switch brand, number of points per room
- Plumbing: pipe brand, sanitaryware and fittings allowance
- Painting: brand, type and number of coats, inside and out
When you compare quotes from different builders, compare specifications, not just rates. A lower rate with a thinner specification is not cheaper; the difference reappears later as extras. Our own construction packages start at ₹1,999 per square foot for Premium, ₹2,499 for Gold and ₹2,999 for Platinum, and in every case the written specification is shared during the consultation and the final figure is confirmed only after a free site visit. Terms and conditions apply, and that is exactly the point: the terms are written down before you sign.
Payment schedule tied to work stages, not dates
The agreement should link every payment to a completed stage of work: agreement signing, foundation, each slab, brickwork, plastering, flooring, finishing and handover. Stage-linked payments protect both sides. You never pay far ahead of the work on the ground, and the builder has a clear, predictable inflow.
Read this section for three things:
- No large upfront demand disconnected from work done
- Clear definition of when a stage counts as complete
- A written process for extras, so nothing is added to a bill verbally
On extras, insist on one specific clause: site-condition costs must be identified before signing, not discovered mid-project. Rock excavation, additional foundation depth and imported filling earth are the usual culprits. We quote these separately after the site visit, in writing, so the agreement you sign already reflects your plot’s realities rather than an idealised one.
Approvals, licences and who pays for what
House construction in Mysuru involves plan sanction, khata and licence work, and connections for power, water and sewage. The agreement should state who runs this paperwork and who pays the statutory fees, because these are two different questions.
The clean arrangement is the one we follow: the company handles plan sanction, khata and licences, and the utility connections, while statutory fees are paid directly by the client to the authority. You get receipts in your own name, and there is no markup hidden inside a “liaison charge”. Every Uniq Builders package includes free assistance for government licensing work, and it is written into the scope rather than offered as a favour.
If a builder’s draft is silent on approvals, ask why. A missing clause here often means the burden lands on you at the worst possible moment.
Drawings, revisions and what you are approving
The agreement should reference the drawings you approved, by name and date, so there is no ambiguity about which version gets built. Before signing, you should have seen working drawings for all floors and the elevation you selected.
Our architectural design service gives clients a choice of 3D elevations, and the one you pick is the one that gets built, with working drawings for every floor and up to three rounds of revisions. Whatever builder you choose, make sure the contract pins the build to specific, signed drawings. “As discussed” is not a drawing.
For homeowners comparing several firms, our guide to choosing builders in Mysuru covers how design capability, in-house teams and documentation habits fit together when you evaluate a shortlist.
Warranty, defects and life after handover
The agreement should not end at handover. Look for two commitments in writing: a workmanship warranty and a defined free-service period. Ask exactly what each covers, how you raise a complaint and how quickly the builder responds.
Every Uniq Builders package includes a workmanship warranty and one year of free service after handover, stated in the agreement rather than promised across a table. When a builder is willing to put after-sales obligations in the contract, it usually reflects confidence in the work itself, because a warranty on poor workmanship is expensive to honour.
Finally, check the practical clauses: how either side can terminate, how disputes are resolved, and confirmation that the builder’s engineers, architects and craftsmen are on the company’s own payroll rather than a loose chain of subcontractors. In-house teams make accountability clauses enforceable in practice, not just on paper.

Frequently asked questions
Should the construction agreement include the material brands?
Yes. Brand names for wiring, pipes, sanitaryware, paint and hardware belong in the written specification attached to the agreement. “Branded fittings” without names gives the builder full discretion, and the substitutions rarely go in your favour.
What if the builder discovers extra work after signing?
Genuine surprises can happen, but the common ones should not. Rock excavation, extra foundation depth and imported filling earth are visible at a proper site inspection, which is why these should be quoted in writing after a site visit and before signing. Any later addition should require your written approval with a price attached.
Is a per square foot rate alone enough to compare builders?
No. A rate only has meaning alongside its specification, payment schedule and warranty terms. Two quotes at the same rate can describe very different houses, so compare the full agreement package rather than the headline number.
